Welcome to RIXQuant. These Terms of Use govern your access to and use of the RIXQuant website, platform, and related services. By accessing or using our services, you agree to be bound by these Terms of Use, as well as our Privacy Policy and any other policies or guidelines we may publish from time to time. If you do not agree with any part of these Terms of Use, you must not access or use our services.

Definitions

In these Terms of Use, "RIXQuant," "we," "us," or "our" refers to the operator of the RIXQuant platform and website. "User," "you," or "your" refers to any individual or entity accessing or using our services. "Services" refers to all features, content, tools, and functionalities provided through the RIXQuant platform.

Eligibility

By using RIXQuant's services, you represent and warrant that you are at least 18 years old (or the age of majority in your jurisdiction) and legally capable of entering into binding contracts. You also represent that you are using our services in compliance with all applicable laws and regulations.

Restricted Jurisdictions

RIXQuant's services are not available to individuals or entities located in, incorporated in, or otherwise subject to jurisdictions designated as restricted under applicable laws, sanctions regimes, or internal compliance policies. You are responsible for ensuring that your use of the services does not violate any such restrictions.

Nature of Services

RIXQuant provides algorithmic trading signal services and related analytical tools. Our services are designed to generate and deliver trading signals based on quantitative models and algorithms. RIXQuant does not provide investment advice, financial advice, tax advice, or legal advice. All trading signals, analytics, and information provided through our services are for informational and educational purposes only.

You acknowledge and agree that all trading and investment decisions are made solely by you, at your own discretion and risk. RIXQuant does not execute trades on your behalf, manage your funds, or have custody of any assets.

Third-Party Brokerage Services

To execute trades based on signals provided by RIXQuant, you must use a third-party brokerage or trading platform of your own choosing. RIXQuant is not a broker, dealer, or exchange. We do not have access to, custody of, or control over your brokerage accounts or funds.

No Guarantees of Performance

RIXQuant makes no guarantees, representations, or warranties regarding the performance, accuracy, or profitability of any trading signals, strategies, or information provided through our services. Past performance is not indicative of future results. Trading in financial markets involves substantial risk of loss and is not suitable for all investors.

Disclaimer of Warranties

The services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. RIXQuant does not warrant that the services will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

Limitation of Liability

To the maximum extent permitted by applicable law, RIXQuant and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages. In no event shall RIXQuant's total aggregate liability exceed the greater of (a) the amounts you have paid to RIXQuant in the six (6) months preceding the claim, or (b) one hundred US dollars (USD $100).

Indemnification

You agree to indemnify, defend, and hold harmless RIXQuant and its affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses arising out of or in connection with your use of the services, your violation of these Terms of Use, or any trading decisions or activities you undertake based on information provided through the services.

User Accounts and Security

To access certain features of the services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Acceptable Use

You agree not to use the services for any unlawful or prohibited purpose. Prohibited activities include violating any applicable laws, attempting to gain unauthorized access, interfering with the services, transmitting harmful code, engaging in fraudulent activities, and reverse-engineering any part of the services.

Intellectual Property

All content, features, and functionality of the services are the exclusive property of RIXQuant or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the services for your personal, non-commercial purposes.

Feedback

If you provide RIXQuant with any feedback, suggestions, or ideas regarding the services, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and distribute such feedback for any purpose.

Third-Party Links and Services

The services may contain links to third-party websites, services, or resources that are not owned or controlled by RIXQuant. We are not responsible for the content, privacy practices, or availability of any third-party sites or services.

Termination

RIXQuant may, in its sole discretion, suspend or terminate your access to the services at any time and for any reason. You may terminate your account at any time by contacting us. Upon termination, your right to use the services will immediately cease.

Governing Law and Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of the United Arab Emirates. You agree that any dispute arising out of or relating to these Terms of Use or the services shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates.

Modifications to Services

RIXQuant reserves the right to modify, suspend, or discontinue any part of the services at any time, with or without notice.

Modifications to Terms

We may revise these Terms of Use from time to time at our sole discretion. By continuing to access or use the services after any revisions become effective, you agree to be bound by the updated Terms of Use.

Severability

If any provision of these Terms of Use is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver

The failure of RIXQuant to enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision.

Entire Agreement

These Terms of Use, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and RIXQuant regarding the services.

Assignment

You may not assign or transfer these Terms of Use without our prior written consent. RIXQuant may assign or transfer these Terms of Use without restriction.

Force Majeure

RIXQuant shall not be liable for any failure or delay in performing its obligations if such failure or delay results from circumstances beyond our reasonable control.
